SPARR User Terms of Service

Martial arts, combat sports, and sparring are inherently dangerous physical activities that carry significant risk of bodily injury, permanent disability, and death. SPARR is a technology platform — a digital tool that facilitates the discovery and organization of sparring sessions and martial arts activities. SPARR does not supervise, oversee, direct, or participate in any physical training or sparring session organized through or facilitated by the Platform.

BY USING THE PLATFORM TO ORGANIZE, JOIN, HOST, OR PARTICIPATE IN ANY SPARRING SESSION, TRAINING ACTIVITY, OR PHYSICAL EXERCISE — WHETHER HOSTED AT A HUB, A PRIVATE LOCATION, OR ANY OTHER VENUE — YOU EXPRESSLY, VOLUNTARILY, AND IRREVOCABLY ASSUME 100% OF THE PHYSICAL RISK ASSOCIATED WITH SUCH ACTIVITIES. This assumption of risk includes, without limitation:

Cuts, bruises, sprains, fractures, and musculoskeletal injuries

Concussions, traumatic brain injury, and neurological damage

Spinal or neck injuries

Organ damage

Permanent disability

Death

You acknowledge that these risks exist regardless of the experience level of participants or the conditions of the venue.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY WAIVE, RELEASE, AND FOREVER DISCHARGE SPARR TECHNOLOGIES, ITS OWNERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, "RELEASED PARTIES") FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, LOSSES, LIABILITIES, DAMAGES — INCLUDING CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES — MEDICAL EXPENSES, FUNERAL COSTS, AND LEGAL FEES ARISING OUT OF OR RELATED TO:

(a) Any injury, illness, disability, or death sustained during or as a result of any sparring session, training activity, or physical exercise facilitated, discovered, or organized through the SPARR Platform;

(b) The conduct, negligence, recklessness, or intentional acts of any other user, hub, trainer, coach, or third party encountered through the Platform;

(c) The physical conditions, safety standards, equipment, or management of any gym, hub, or venue where an activity takes place;

(d) Your own actions, inactions, or decisions made in connection with any physical activity organized through the Platform.

THIS WAIVER APPLIES EVEN IF THE INJURY IS CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES.

SPARR does not own, operate, inspect, certify, or control any Hub or gym listed on the Platform. Hubs are independent third-party entities. SPARR makes no representations or warranties regarding the safety, licensing, staffing, insurance coverage, equipment standards, or operational practices of any Hub. You acknowledge that your decision to train at or interact with any Hub is made entirely at your own risk and judgment. SPARR is not responsible for any injury, loss, or damage arising from the conditions, acts, or omissions of any Hub or its personnel.

You represent and warrant that you are in adequate physical health to participate in the activities you organize or join through the Platform. SPARR strongly recommends that you obtain medical clearance from a licensed physician before engaging in any martial arts or combat sports activities.
