SPARR User Terms of Service

1. ACCEPTANCE OF TERMS
By creating an account, accessing, or using the SPARR mobile application ("App") or any associated services (collectively, the "Platform"), you ("User") agree to be legally bound by these Terms of Service ("Terms"). IF YOU DO NOT AGREE TO ALL OF THESE TERMS, YOU MUST NOT USE THE PLATFORM. These Terms constitute a binding legal agreement between you and SPARR Technologies ("SPARR," "we," "us").
2. ELIGIBILITY
You must be at least 16 years of age to create an account. By agreeing to these Terms, you represent and warrant that you meet this requirement and that all information you provide is accurate.
3. USER ACCOUNTS
You are responsible for maintaining the confidentiality of your login credentials. You are fully responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use at support@sparr.app.
4. PERMITTED USE
You may use SPARR to: Create and maintain a martial arts profile Discover, host, and join sparring sessions via the map feature Upload training media and interact with other users Connect with Hubs and gyms You may not use SPARR to harass, threaten, or harm other users; distribute illegal or harmful content; or misrepresent your identity or qualifications.
5. ⚠️ PHYSICAL ACTIVITY, SPARRING, AND ASSUMPTION OF RISK
READ THIS SECTION CAREFULLY. IT DIRECTLY AFFECTS YOUR LEGAL RIGHTS.
5.1 Nature of Activity
Martial arts, combat sports, and sparring are inherently dangerous physical activities that carry significant risk of bodily injury, permanent disability, and death. SPARR is a technology platform — a digital tool that facilitates the discovery and organization of sparring sessions and martial arts activities. SPARR does not supervise, oversee, direct, or participate in any physical training or sparring session organized through or facilitated by the Platform.
5.2 Complete Assumption of Risk
BY USING THE PLATFORM TO ORGANIZE, JOIN, HOST, OR PARTICIPATE IN ANY SPARRING SESSION, TRAINING ACTIVITY, OR PHYSICAL EXERCISE — WHETHER HOSTED AT A HUB, A PRIVATE LOCATION, OR ANY OTHER VENUE — YOU EXPRESSLY, VOLUNTARILY, AND IRREVOCABLY ASSUME 100% OF THE PHYSICAL RISK ASSOCIATED WITH SUCH ACTIVITIES. This assumption of risk includes, without limitation:
Cuts, bruises, sprains, fractures, and musculoskeletal injuries
Concussions, traumatic brain injury, and neurological damage
Spinal or neck injuries
Organ damage
Permanent disability
Death
You acknowledge that these risks exist regardless of the experience level of participants or the conditions of the venue.
5.3 IRONCLAD LIABILITY WAIVER
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY WAIVE, RELEASE, AND FOREVER DISCHARGE SPARR TECHNOLOGIES, ITS OWNERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, "RELEASED PARTIES") FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, LOSSES, LIABILITIES, DAMAGES — INCLUDING CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES — MEDICAL EXPENSES, FUNERAL COSTS, AND LEGAL FEES ARISING OUT OF OR RELATED TO:
(a) Any injury, illness, disability, or death sustained during or as a result of any sparring session, training activity, or physical exercise facilitated, discovered, or organized through the SPARR Platform;
(b) The conduct, negligence, recklessness, or intentional acts of any other user, hub, trainer, coach, or third party encountered through the Platform;
(c) The physical conditions, safety standards, equipment, or management of any gym, hub, or venue where an activity takes place;
(d) Your own actions, inactions, or decisions made in connection with any physical activity organized through the Platform.
THIS WAIVER APPLIES EVEN IF THE INJURY IS CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES.
5.4 Hub and Gym Disclaimer
SPARR does not own, operate, inspect, certify, or control any Hub or gym listed on the Platform. Hubs are independent third-party entities. SPARR makes no representations or warranties regarding the safety, licensing, staffing, insurance coverage, equipment standards, or operational practices of any Hub. You acknowledge that your decision to train at or interact with any Hub is made entirely at your own risk and judgment. SPARR is not responsible for any injury, loss, or damage arising from the conditions, acts, or omissions of any Hub or its personnel.
5.5 Medical Clearance
You represent and warrant that you are in adequate physical health to participate in the activities you organize or join through the Platform. SPARR strongly recommends that you obtain medical clearance from a licensed physician before engaging in any martial arts or combat sports activities.
6. MEDIA AND CONTENT
You retain ownership of media you upload. By uploading content, you grant SPARR a non-exclusive, royalty-free, worldwide license to display such content within the Platform. You warrant that you own the rights to all content you upload and that it does not violate any third-party rights or applicable law.
7. INTELLECTUAL PROPERTY
All Platform software, design, trademarks, and branding are the intellectual property of SPARR Technologies. You may not copy, modify, or distribute any part of the Platform without written permission.
8. TERMINATION
SPARR reserves the right to suspend or permanently terminate your account at its discretion, with or without notice, for violations of these Terms or for conduct deemed harmful to the Platform or its users.
9. DISPUTE RESOLUTION
Any disputes arising from these Terms or your use of the Platform shall be first attempted to be resolved through good-faith negotiation. Failing that, disputes shall be subject to binding arbitration under the laws of the Hashemite Kingdom of Jordan, with the courts of Amman having non-exclusive jurisdiction for any matters not resolved through arbitration.
10. GOVERNING LAW
These Terms are governed by the laws of the Hashemite Kingdom of Jordan, without regard to conflict of law principles.
11. SEVERABILITY
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
